  • Is not as described on the menu.
  • Is unfit for its intended purpose.

Refund and Return Process

  • Proof of Purchase: You must provide a valid receipt or proof of purchase to be eligible for a refund or replacement.
  • Assessment: The restaurant reserves the right to assess the food or service before providing a remedy. For takeaway orders, it is recommended to notify the shop immediately if there is an issue.
  • Major Failures: If there is a major problem (e.g., the order is completely wrong or inedible), you have the right to choose between a full refund or a replacement.
  • Minor Failures: If the problem is minor (e.g., a missing side item), the restaurant may choose to fix the problem by providing the missing item or offering a partial refund.

Exceptions

  • Change of Mind: Under Australian law, the restaurant is not required to provide a refund if you simply change your mind, order the wrong item, or decide you do not like the taste of a dish that was otherwise prepared correctly.
  • Perishable Goods: Due to health and safety regulations, food items generally cannot be “returned” once they have left the premises if they were prepared according to the order.
